1. Introduction
Edgewater Studios is a professional audio recording facility. Customer service and satisfaction are our top priorities. The following policies ensure that all sessions are conducted in the most professional manner while providing our clients a creative and comfortable environment.
2. Deposit / Requesting Time Slot
All sessions booking less than 40 hours worth of studio time require payment in advance to confirm the session. Sessions that are not paid in advance are not confirmed and, consequently, subject to cancellation.
For sessions booking 40 or more hours worth of studio time, a deposit of 50% is required to confirm the session, with the remaining 50% due before release of the work materials produced by the session.
Payments for all services can be made electronically via credit card or bank account via the electronic invoice emailed to each client. Payment can also be made via credit card over the phone. Credit card authorization forms are required for all clients that retain Edgewater for recurring monthly services.
3. Booking Rates
Sessions are booked at the rates expressed by the studio (subject to change) unless other rates have been negotiated. There is a one (1) hour minimum. Sessions that run longer than the original scheduled time will be subject to additional fees at the published rate assuming the studio is available.
Lockout sessions are based on 8-hour days. Additional time will be charged at our standard hourly rate.
4. Cancellation Fee
Cancellations within 48 hours of the scheduled session forfeit the payments provided.
Edgewater does not issue refunds. However, if notified within 48 hours of the session, payments made can be applied to the client’s internal account and used for future services.
5. Start / End and Session Times
The session clock begins at the scheduled time that both parties agree upon. If the client arrives early and the studio can accommodate an early start, then the session clock will begin at that earlier time.
Please note that there should be no expectation that your session can begin earlier than the agreed-upon time. Your best bet is to arrive a few minutes before your scheduled start time so that you can begin your session right on time.
If a client is late for any reason, the client will be charged from the scheduled session start time with no exceptions.
Setup time is billed at regular studio rates and is part of the hours booked for sessions. This includes load-in and instrument setup, microphone placement, level setting, media transfer, etc., all of which are an important part of the work we do for our clients.
6. Payment
Clients are responsible for all monies due to the studio and shall make payment to the studio with cash, credit card or previously approved check.
No media will be turned over to the client until full payment is made for the services provided. Clients will also be responsible for all legal, attorney and collection fees, if required for payment. If an account is not paid in full, immediate collection and legal action will be taken.
Receipt of recording media by client from the studio is acknowledgement between both parties that the quality of all services rendered by Edgewater is satisfactory to Client and shall release Edgewater from any and all liability regarding said recording media and services rendered.
7. Session Media
Session media will only be released when full payment for the session is received.
Edgewater does not store or backup session media for clients. If the client desires to retain session media, the client needs to bring the associated storage devices needed to transfer the session media to the client. Edgewater is not expected to maintain a backup copy of the session unless other arrangements have been made in writing.
Edgewater does not transfer mix sessions to clients. For projects requiring mixing by the client, Edgewater will provide the client with a WAV version of the mix approved by the client. Session media for mix sessions, however, are proprietary and will not be provided to the client.
It is recommended that each client make a back-up copy of the sessions immediately. Edgewater is not responsible for any unrecoverable data.
8. Gear Left By Client
Edgewater is not responsible for lost, damaged, or stolen gear left behind. Any property left past 30 days will become the property of Edgewater unless other arrangements have been made.
9. Equipment / Facility Damage
In the event a piece of studio gear owned by Edgewater or any part of its facility becomes damaged by the client, or anyone associated with the client, due to negligence, accident, or willful act, the client is expected to provide monetary compensation in the amount of full replacement value of the damaged item.
Damage to the studio property of any kind that is a result of anyone in the client’s party or group will be assessed to the client’s account and payment for said damages will be required before any media is released to the client. In the event that the damages remain unpaid by the client, Edgewater reserves the right to pursue legal action against the client.
10. Studio Rules
- No smoking in the studio. Smoking is permitted on the front patio outside or in the parking lot.
- Food and drink is encouraged to be consumed in the lounge area and outside. Food and drink may be brought into the studio, but must be kept away from equipment racks and out of all associated tracking rooms. Water is the only beverage allowed in any tracking space and lids are required.
- Illegal drugs are strictly prohibited and Edgewater reserves the right to refuse service or cancel a session if a client appears to be under the influence.
- Masks are required at all times in the studio for all individuals that have not been vaccinated for the COVID-19 virus. Edgewater reserves the right to refuse service or cancel a session without refund if the client does not comply with this mandate.
- No firearms are allowed on the premises.
- Unwanted trash needs to be put in the receptacles provided.
- Only individuals essential to the recording can be present during the booked time. If guests are to accompany the client, this needs to be reviewed with Edgewater in advance.
11. Responsibility
The person responsible for paying for studio time will be held responsible for the actions of all artists and guests he or she brings to any session. These rules apply to all persons without exception. This ensures a healthy business relationship for the recording artist and for the studio as well.
The client affirms that he/she is the rightful owner or assignee of material to be recorded or reproduced. Edgewater and its employees are not responsible for copyright violations, talent or creative royalties, mechanical reproduction licenses, or any other liabilities for such material.
Client also agrees to indemnify Edgewater and its employees for any and all claims, costs, losses, detriments and expenses of any kind or nature. Including, without limitation, attorney’s fees and cost incurred by Edgewater by reason of any breach or alleged breach of any representation, warranty, or agreement made by client.
